Did you get a derelict vessel citation that you think you don’t deserve, or, you received a citation and are not the vessel owner? The City issues citations to reduce or eliminate the threats posed by derelict vessels.

Derelict vessels pose potential hazards to safe navigation and commercial and recreational use of city waters as well as to the environment. The City monitors public waterways and adjoining shorelines in order to keep Miami safe and beautiful.

Determine If You Can Request an Administrative Hearing.

The recipient of a derelict vessel citation may request an administrative hearing before the code enforcement board to show that the condition(s) alleged in the notice does not exist or that the derelict vessel is not derelict.  In the request for hearing, this person is referred to as the "petitioner".

If you'd like to request an administrative hearing, you may do so by completing the questionnaire below. You may request a hearing no later than 21 days after the notice was given. Failure to request a hearing shall be deemed a waiver of the right to a hearing and an agreement to the remedy of removal, impoundment, sale, destruction, or other disposition of the derelict vessel.

What Happens Next?

  • Your submission will be reviewed in 5-7 business days.
  • If your administrative hearing request is timely and complete, the office of hearing boards shall send a written notice of hearing by certified mail, return receipt requested, to the petitioner at his or her mailing address stating the time, date, and location of the hearing.  
  • You must attend the administrative hearing on the date, time, and location provided.
  • At the hearing, be sure to present any documents that you think may help your case.
