Request an Extension of Time Hearing for Code Enforcement Case

Are you a property owner with an open Code Enforcement case where the violation is 'not complied' (has not been fully corrected) and would like to request more time from the Code Enforcement Board to correct the violation?  The City of Miami understands that you may need more time to address your code violations. 

IMPORTANT NOTE: Extension of time requests are ONLY to be used for property violations that have already been adjudicated before the Code Boards or Special Magistrate. If you need to request a continuance of a case set for an adjudicatory hearing before the Code Board or Special Magistrate, please contact via email or telephone the issuing Inspector at least 24 hours in advance of the scheduled hearing date.

Determine Your Eligibility.

Only the owner(s) or someone with legal standing (i.e. Legal Counsel, Power of Attorney) on behalf of the owner(s) can request this type of hearing. All Power of Attorneys must be notarized and will be reviewed by the Legal Department.

NOTE: You will be required to upload the Power of Attorney document in pdf. format when completing the questionnaire to request a hearing.

What You Will Need.

  • Case Number: Your case number can be found on your Notice of Violation (e.g. 2018000000). 
  • Power of Attorney, if applicable: A valid power of attorney is required if you are not the owner. NOTE: You will be required to upload this document in PDF format when completing the questionnaire.
  • IMPORTANT NOTE: All documents and information submitted for a public hearing become a public record available to anyone who seeks public information. It is important that you do not submit any sensitive information.

What Happens Next?

  • Your request will be reviewed along with your supporting documentation (Power of Attorney, if applicable).
  • If your documents are correct, you will receive a notification of your hearing date, time, and location via email within 3-5 business days.
  • You will need to be present at the hearing.
  • At the hearing, the Board will make a Motion regarding your request for an Extension of Time and the length of the extension.
