 Notice is hereby given that a Referendum Special Election will be held on Tuesday, November 8, 2022 from 7:00 A.M. until 7:00 P.M. in the City of Miami, Florida, at the polling places in the several Referendum Special Election precincts designated by the Supervisor of Elections of Miami-Dade County, Florida, as set forth herein, unless otherwise provided by law, and submitting to the qualified electors of the City of Miami, Florida, the following question listed on the Official Sample Ballot below.

Qualified electors will have the option to vote Yes or No on the charter amendment question.

Shall Miami's Charter be amended authorizing City to amend Hyatt Lease with HRM Owner LLC, including Knight Center property, extending to 99 years, waiving bidding, and requiring, at no cost to city:

Vote Early 
There will be a Secure Ballot Intake Station (Vote-By-Mail Ballot Drop Box) available and staffed at each of the Early Voting locations during the Early Voting hours of operation.

  • General Election and City of Miami Special Election - Early Voting: Monday, October 24, 2022  through Sunday, November 6, 2022 from 7:00 a.m. to 7:00 p.m.

City of Miami registered voters may choose to vote at any of the Early Voting Sites on the dated and times in which they are open.

Vote-By-Mail Information (VBM)
Per state law, any voter who wishes to have a mail ballot sent to their home must submit their request no later than 5:00 p.m. on the day specified below. Requests may be submitted to Miami-Dade County Election's office. 

  • General Election and City of Miami Special Election: Last day to request VBM is Saturday, October 29, 2022 at 5:00 p.m

 Miami-Dade County Supervisor of Elections Department is located at  2700 NW 87th Avenue, Miami, FL 33172 and will be open until 5:00 p.m.

Mailing of Vote-By-Mail Ballots Timeline:

No later than 45 days before each presidential preference primary election, primary election, and general election, the supervisor of elections shall send a vote-by-mail ballot ...to each absent uniformed services voter and to each overseas voter who has requested a vote-by-mail ballot.

The supervisor shall mail a vote-by-mail ballot to each absent qualified voter, other than those listed above, who has requested such a ballot, between the 40th and 33rd days before the presidential preference primary election, primary election, and general election. 

Note: A vote-by-mail ballot must be returned and received by the Supervisor of Elections no later than 7:00 p.m. (local time) on election day for the respective election, in order to be counted.

If a voter forgets to sign their vote-by-mail envelope or their signature does not match, state law allows voters the opportunity to submit an affidavit to cure their vote-by-mail ballot. The affidavit must be completed and submitted to the Miami-Dade County Elections Department, along with a copy of their identification, by 5:00 p.m. on the second day after an election.

Provisional Ballot - A person casting a provisional ballot shall have the right to present written evidence supporting their eligibility to vote to the Supervisor of Elections by no later than 5:00 p.m. on the second day following the election.

Tuesday, November 8, 2022 – On Election Day, polls will be open from 7:00 a.m. to 7:00 p.m. and voters must go to their assigned voting location. Voters whose polling place are changed will be notified by mail and signage will be placed at the original location redirecting the voter to the new location, consistent with Florida Statute.

This Charter Amendment will amend Section 29-B of the Miami Charter to authorize the City Commission by a four-fifths (4/5ths) affirmative vote, to waive competitive bidding and execute an amended and restated lease with HRM Owner LLC, to grant HRM Owner LLC a term not to exceed ninety-nine (99) years, to include the adjacent James L. Knight Center property, providing for fair market value rent including the greater of participation rent of 2.5% of gross revenues and increased annual rent from $250,000.00 to $2,500,000.00, and also requiring  that the tenant redevelop the property and include a 615-key hotel,188,000 sf convention/meeting space, 682 apartments, parking, a $25,000,000.00 affordable housing contribution to the City, additional public green space and an expanded Riverwalk at its sole expense and at no cost to the City.

KNIGHT CONVENTION CENTER PROPERTY AT 298, 300, 330, & 400 SOUTHEAST 2ND AVENUE (COLLECTIVELY, "PROPERTY”), PROVIDING FOR THE REDEVELOPMENT OF THE PROPERTY TO INCLUDE AT LEAST A 615 KEY HOTEL, 188,000 SQUARE FEET OF CONVENTION/MEETING SPACE, 682 APARTMENTS, PARKING, ADDITIONAL PUBLIC OPEN SPACE, AND AN EXPANDED PUBLIC RIVERWALK, ALL AT NO COST TO THE CITY, FOR NO LESS THAN FAIR MARKET VALUE RENT, CONSISTING OF THE GREATER OF PARTICIPATION RENT EQUAL TO 2.5% OF GROSS REVENUES OR AN INCREASE OF MINIMUM RENT FROM $250,000.00 TO $2,500,000.00 ANNUALLY, AND FURTHER PROVIDING THAT TENANT SHALL MAKE A MINIMUM $25,000,000.00 AFFORDABLE HOUSING CONTRIBUTION, WITH RESTRICTIONS, REVERSIONS, AND RETENTION BY THE CITY OF ALL OTHER EXISTING CITY RIGHTS; CALLING FOR A REFERENDUM AND PROVIDING THAT THE CHARTER AMENDMENT NO.1 WILL BE SUBMITTED TO THE ELECTORATE AT THE REFERENDUM SPECIAL ELECTION TO BE HELD CONCURRENTLY WITH THE GENERAL ELECTION ON NOVEMBER 8, 2022; DESIGNATING AND APPOINTING THE CITY CLERK AS THE OFFICIAL REPRESENTATIVE OF THE CITY COMMISSION WITH RESPECT TO THE USE OF VOTER REGISTRATION BOOKS AND RECORDS; FURTHER DIRECTING THE CITY CLERK TO CAUSE A CERTIFIED COPY OF THE HEREIN RESOLUTION TO BE DELIVERED TO THE SUPERVISOR OF ELECTIONS OF MIAMI-DADE COUNTY, FLORIDA NOT LESS THAN FORTY-FIVE (45) DAYS PRIOR TO THE DATE OF SUCH ELECTION; FURTHER  DIRECTING THE CITY MANAGER TO USE GOOD FAITH EFFORTS TO BRING BEFORE THE COMMISSION FOR 4/5THS APPROVAL A FULLY NEGOTIATED LEASE AGREEMENT, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY ON OR BEFORE THE DECEMBER 8, 2022 REGULAR CITY COMMISSION MEETING, SUBJECT TO APPROVAL BY THE ELECTORATE ON NOVEMBER 8, 2022; PROVIDING AN IMMEDIATE EFFECTIVE DATE FOR THIS RESOLUTION.

Campaign Treasurer's Reports

Each campaign treasurer designated, shall file Campaign Treasurer’s Reports of all contributions received, and all expenditures made. Campaign Treasurer’s Reports shall be filed on or before the due dates listed above.

Campaign Treasurer’s Reports shall be filed with the Office of the City Clerk.  Campaign Treasurer’s Reports shall be filed through the City’s electronic filing system using the Online Reporting Application.  To access the application, the political committee must first obtain a login ID and password from the Office of the City Clerk.  Online submissions of Campaign Treasurer’s Reports must be received no later than midnight (Eastern Standard Time) on the day designated per Section 106.0705 (3), Florida Statutes.  Failure to electronically file a Campaign Treasurer’s Report on the designated due date will subject the political committee to a fine for each late day as provided in Section 106.07 (8)(b), Florida Statutes.

In any reporting period during which a political committee has not received any contributions or expended any reportable funds, a Waiver of Report (Form DS-DE 87) can be filed electronically on or before the due dates listed above with the Office of the City Clerk.

Campaign Treasurer's Reports:  

Each campaign treasurer designated by a candidate, Political Committee (PC), or Electioneering Communication Organizations (ECO) shall file Campaign Treasurer’s Reports of all contributions received, and all expenditures made, by or on behalf of such candidate. Campaign Treasurer’s Reports shall be filed on or before the due dates listed above.

Campaign Treasurer’s Reports shall be filed with the Office of the City Clerk.  Campaign Treasurer’s Reports shall be filed through the City’s electronic filing system using the Online Reporting Application.  To access the application, the candidate, PC or ECO must first obtain a login ID and password from the Office of the City Clerk.  Online submissions of Campaign Treasurer’s Reports must be received no later than midnight (Eastern Standard Time) on the day designated per Section 106.0705 (3), Florida Statutes. Any candidate, PC or ECO failing to electronically file a Campaign Treasurer’s Report on the designated due date shall be subject to a fine for each late day as provided in Section 106.07 (8)(b) and 106.0703(7), Florida Statutes.  Such fine shall be paid only from personal funds of the candidate.

In any reporting period during which a candidate, PC or ECO has not received any contributions or expended any reportable funds; a candidate, PC or ECO must electronically file a Waiver of Report, Form DS-DE 87, on or before the due dates listed above with the Office of the City Clerk.
