The Executive Secretary advised the Board of the employee’s request to carry this item over to the next meeting. The Chair responded that he’d rather dispense with this matter, and the Board approved the Department’s extension request.

Copy of a Request to continue from Adanna Ferguson, Assistant City Attorney, concerning the Appeal Hearing of Maria Busto, Marina Supervisor, pursuant to Civil Service Rule 14 of the 10-day suspension (CSB#21-12D). Libby H. Navarrete, Attorney, expressed no objection to the request. (DISCUSSION). Appeal Hearing is scheduled for today.

Adanna Ferguson, Assistant City Attorney, appeared before the Board on behalf of the Department. Libby H. Navarrete, Attorney, on behalf of Ms. Busto, Marina Supervisor, appeared via Zoom, expressing no objection to the request to continue.

Motion by Board Member Cabrera, seconded by Board Member Lindsey, that this matter be Approved, passed by the following vote:

The 2021 Annual Board Report to the City Commission. (DISCUSSION)

The Executive Secretary presented the Annual Board Report and responded to the Board’s questions. Following discussion, the Board entered a motion to APPROVE the Annual Report, which resulted as follows:

G.        Requests for Hearings

G.1

Copy of a Request for an Appeal Hearing from Osnat K. Rind, Attorney, on behalf of Anishka Anderson, Code Compliance Inspector, concerning an alleged 50-minute fine on December 1, 2021. (DISCUSSION)

ACA Ferguson advised the Board that this matter is expected to be resolved within a few weeks. Attorney Osnat K. Rind appeared before the Board via Zoom on behalf of Anishka Anderson and confirmed the possibility of resolution without Hearing. Following discussion, the Board agreed to carry over this matter to the next agenda.

H.        Today's Hearings

H.1

Appeal Hearing on behalf of Maria Busto, Marina Supervisor, concerning her 10-day suspension, effective July 27, 2021.

 Please refer to Item E1.

H.2

Appeal Hearing on behalf of Luis G. Rodriguez, Police Sergeant, concerning his 40-hour suspension, effective July 24, 2021.

The Board was advised of a memorandum from Interim Chief Manuel A. Morales, reducing Officer Rodriguez' disciplinary action to a Reprimand, only. This matter will be closed and removed from the Board's docket.
