Effective May 1, 2005

The following buildings, structures, and facilities are exempt from the Florida Building Code rules and regulations; therefore, will not be required to obtain building permits from the City of Miami Building Department.

Any work exempt under Florida Statute 553.73 (8). (See below).

-Building and structures specifically regulated and preempted by the Federal Government.
-Railroads and ancillary facilities associated with the railroad.
-Nonresidential farm buildings on farms.
-Mobile homes (Exterior work, ramps, etc requires a permit).
-Electric utilities structures or facilities as defined in S. 366.02, directly involved in the generation, transmission, or distribution of electricity.
-Temporary sets assemblies, or structures used in commercial motion picture or television production, or any sound-recording equipment used in such production, on or off the premises.
-Chickee Huts constructed by the Miccosuke Tribe of Indians or the Seminole Tribe of Florida. The term “chickee” means an open wooden hut that has a thatched roof or palmetto or other traditional materials, and that does not incorporation any electrical, plumbing, or other non wood features.
-Miami-Dade County School Board facilities and State Universities on State owned property.
-Building and structures on private property preempted by state statute.

Definitions applicable to the exemptions below:

*Repair: The reconstruction or renewal of any part of an existing building for the purpose of its maintenance.

*Alteration: Any construction or renovation to an existing structure other than repair or addition.

New exemptions; the following minor repairs will not require building type permits. (FBC. -Current).

-*Repair work, which does not alter the existing condition, performed by licensed general or building contractors that is not structural in nature (interior or exterior), does not change the approved occupancy, does not affect life safety, and the value does not exceed $1,000 of estimated cost including labor and materials.

-*Repair work of any roof covering not exceeding $1,000 in labor and materials, or work not exceeding two (2) roof squares.

-Surfacing of existing interior floors or slabs, within single family residences, duplexes or condominium units, not part of an assembly, with carpet, tile, wood, or other similar floor covering. Does not include common areas of residential buildings. Wall covering in residential areas are exempt, such as paneling, wall paper, etc.

-Painting (interior & exterior) permits are exempt, except in historical designations.

-Replacement of kitchen cabinets and vanities, in residential units, such as family residences, duplexes or condominium units.

Definitions applicable to the exemption below:

*Repair: The reconstruction or renewal of any part of an existing building for the purpose of its maintenance.
*Alteration: Any construction or renovation to an existing structure other than repair or addition.

Mechanical type permits that will be exempt from permitting requirements, (FBC. - Current).

-Portable heating equipment.
-Portable ventilation equipment.
-Portable cooling equipment.
-Portable evaporative cooler.
-Replacement of any part which does not alter its approval or makes it unsafe.
-*Replacement of any load management control device.
-*Repair Work performed by licensed mechanical contractors that does not exceed $500 in value of labor and materials.
-*Repair of air conditioning duct.
-*Repair or replace coil, compressor or refrigerant piping by licensed mechanical contractor.
-*Repair or replace non-combustion heating by licensed mechanical contractors.
-*Repair ventilation fans.
-Installation of ductless ventilation and range hoods. (Please Note: This particular type of work may require an Electrical Permit even though a Mechanical Permit is not. Plumbing, electrical, and mechanical permits are exempt if they meet the exemption requirements for that disciplines.)

Definitions applicable to the exemption below:

*Repair: The reconstruction or renewal of any part of an existing building for the purpose of its maintenance.
*Alteration: Any construction or renovation to an existing structure other than repair or addition.

Electrical type permits will be exempt from permitting requirements, (FBC. - Current).

-*Repair work performed by licensed electrical contractors that does not exceed $500 in value of labor and materials, including emergency repair.-*Repair or replace electrical wall switches or outlet devices rated less than 20 amps at 120 volts.
-*Repair or replace electric water heaters rated less than 4,000 watts.
-*Repair or replace electric wiring to pumps not exceeding 2HP.
-*Repair or replace time clocks.
-*Repair or replace the following low voltage (under 77 volts) devices or jack:

Telephone
Television
Data Cable
Central Vacuum
Burglar Alarm (residential only)
Intercom system

Definitions applicable to the exemption below:

*Repair. The reconstruction or renewal of any part of an existing building for the purpose of its maintenance.
*Alteration. Any construction or renovation to an existing structure other than repair or addition.

Plumbing type permits will be exempt from permitting requirements, (FBC. - Current).

-*Repair work performed by licensed plumbing contractors that does not exceed $500 in value of labor and materials.
-*Repair or replace gas appliances, other than water heaters, by licensed plumbing contractors.
-*Repair solar panels by licensed plumbing contractors.
-*Replace fan of above ground LP tank on the same location, by the same gas company.
-*Repair irrigation system.
-*Repair domestic water service-lines.
-Clear sewer stoppage.
-*Repair sewer line (except interceptors/separators) by license plumbing contractors.
-*Repair or replace faucets, valves.
-*Repair or replace residential (non-electrical) pool equipment, such as filters, etc.
-*Repair or replace shut off valve on a domestic water line,
-Capping of waste line leading to septic tank (Note: capping falls the jurisdiction of the HRS Department)
-*Repair or replace disposal in single family residences, duplexes or condominium units.
-*Repair or replace dishwasher within single family residences, duplexes or condominium units.
